The inspector found there to be outstanding requirements from the previous inspection report but made no statutory requirements on the home.

What the care home does well

Service users or their representatives are given enough information about the home before they move in. Someone from the home visits them prior to admission and they are offered the opportunity to visit the home for a look around and to ask questions about how the service is delivered. This enables them to make an informed decision as to whether the home is the right place for them to live. The home is clean and comfortable. One service user said "It is always beautifully clean" Staff are kind and helpful and make an effort to provide the service in the manner that service users want. Comments made by service users included "Its very good living here" and "I love it." Routines are flexible and emphasis is placed on maintaining the independence of people using the service enabling them to exercise choice in key areas of their lives. Examples given included rising and retiring times, clothes, food and activities. This ensures that service users maintain some control. Staff promote the rights of service users to access the health care professionals that they need. A good choice of food and drinks are available. This ensures that service users receive a varied and nutritious diet. One service user spoken to said "The food is excellent." There are various outings arranged and in house activities, which allow service users contact with the wider community and provide stimulation. Arrangements are made for religious worship. Visitors are encouraged and made welcome. There is a clear and user-friendly complaints procedure and managers show a positive approach to complaints and ideas for improvement. This promotes openness and transparency which helps service users to say if they are not happy with any aspect of the service. The staff are provided with comprehensive training to improve their knowledge and skills. This means that service users receive care from a well-informed staff team whose practice is up to date. The safety of service users is an important aspect of the service delivered. It is demonstrated through good recruitment practices, some risk assessments, staff training and the servicing of equipment and maintenance of the premises. The home is managed in a manner that is service user focussed. It concentrates on the needs and wishes of the people who use the service.

What has improved since the last inspection?

The way in which some drugs are stored is more secure and in line with the legislation relating to the safe storage of controlled drugs. Hot water is monitored in a manner that ensures the delivery of safe hot water and thereby minimises the risk of scalding. The arrangements for ensuring staff are aware of issues relating to hazardous substances is currently under review. This minimises the risk of injury or harm.

What the care home could do better:

Admissions to the home must only take place when a full needs assessment has been undertaken and the home can confirm that they can meet the needs of the individual through the service they deliver. Staff who are responsible for the placing of people in the home need to be better informed about the homes registration category. This avoids the placement of people in a home where their needs cannot be met as well as breaking the law. Following admission all of the paperwork should be completed to ensure that the organisations policy and procedures are properly followed and nothing gets missed. This ensures that the checks that the organisation wants done are completed in order to ensure service users are consistently admitted properly. Each service user must have a care plan that has been agreed with them or their representative. It should be written in plain English, easy to understand and consider all areas of the individual`s life including health, personal, cultural and social care needs. The plan must include the support that staff have to provide to meet the needs of service users whilst maintaining their ability to retain some independence. Areas should be identified where staff are willingto support residents to take some risks in order for them to live interesting and fulfilling lives. Staff need to be provided with the skills and ability to support and encourage service users to be involved in the development of their plan and make the process interesting and worthwhile. Plans must be properly reviewed and where needs have changed, action taken and the plan amended accordingly. Good care planning means that service users receive a service that is specifically designed to meet their diverse care needs. The management of continence needs to be more discreet to ensure the privacy and dignity of service users The work required by the fire authority to improve safety relating to the means of escape should be done. This ensures that service users safety is not compromised in the event of a fire.

The home was purpose built approximately 35 years ago and is located close to the centre of the busy market town of Bedale. Bedrooms are arranged over three floors and are intended for single occupancy. All floors are accessed via a passenger lift. At the time of this visit the weekly charge is £368:90. The home makes no additional charges. The Commission for Social Care inspection reports are displayed in the home for anyone to read. The accumulated evidence used in this report has included: • A review of the information held on the homes file since its last inspection. • Information submitted by the registered provider in the Pre Inspection Questionnaire • An unannounced visit to the home, which lasted eight hours. This visit included a tour of the premises; talking to service users, care staff, and managers. Examining some records and observing staff working with service users. Prospective service users have the information they need to make an informed choice about where to live. Each service user has a written contract/ statement of terms and conditions with the home. No service user moves into the home without having had his/her needs assessed and been assured that these will be met. Service users and their representatives know that the home they enter will meet their needs. Prospective service users and their relatives and friends have an opportunity to visit and assess the quality, facilities and suitability of the home. Service users assessed and referred solely for intermediate care are helped to maximise their independence and return home. The Commission considers Standards 3 and 6 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 3. Standard 6 does not apply to this service. Quality in this outcome area is adequate This judgement has been made using available evidence including a visit to the service. Some aspects of the assessment/admission procedures runs the risk of service users being inappropriately placed. EVIDENCE: Case tracking confirmed differing practice regarding pre admission assessments. All of the files included the care managers assessment but not all contained the homes own assessment. Some of the key admission documents had not been completed. From observations of service users and discussions with staff it became apparent that a service user had been admitted to the home with specialist needs relating to bereavement, alcohol and suicidal tendencies. The home is registered to provide a service for people whose primary need for care is infirmity due to old age. This means that the home has admitted a resident outside its registration category (Section 8, Schedule 7 The National Care Benkhill Lodge - North Yorkshire County Council DS0000034358.V306972.R01.S.doc Version 5.2 Page 10 Standards Commission (Registration) Regulations 2001) and is therefore in breach of its registration. The care management/social work staff that are employed by the registered provider must be made aware of the legislation relating to the registration of care homes and should not be placing people in homes that have needs that are outside of the homes category of registration. To do so places service users at risk of not receiving the service that they need. The manager must resist attempts to have people placed in the home where their need for care is not in line with the homes registration category. The Service User Guide is given to each service user and service user files contained evidence that Terms and Conditions had been issued. This means that service users/representatives have information about the type of service that they can expect to receive. Someone from the service visits prospective service users at home or in hospital and discusses their care needs. Relatives are involved where possible to find out more information that the service user may not be able to provide. Service users spoken to confirmed that they had had the opportunity to visit and that they were given enough information about the home before they moved in. This had helped them to make a decision as to whether or not Benkhill Lodge would be the right place for them to live. On admission a key-worker is allocated to each service user and after six weeks a review is held to decide whether the service user wants to live in the home permanently. Four staff spoken to were able to describe how they welcome new service users to the home and help them to settle in. They were sensitive to the ordeal that service users experience when having to make this life changing decision. The service user’s health, personal and social care needs are set out in an individual plan of care. Service users’ health care needs are fully met. Service users, where appropriate, are responsible for their own medication, and are protected by the home’s policies and procedures for dealing with medicines. Service users feel they are treated with respect and their right to privacy is upheld. Service users are assured that at the time of their death, staff will treat them and their family with care, sensitivity and respect. The Commission considers Standards 7, 8, 9 and 10 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 7,8,9and 10 Quality in this outcome area is adequate. This judgement has been made using available evidence including a visit to the service. Inadequate care planning has the potential to place service users at risk of not having all their health and personal care needs met in accordance with their wishes. EVIDENCE: Case tracking confirmed poor practice regarding care planning. All of the care plans examined were either incomplete in key areas or did not contain the relevant information asked for on the form. This lack of detailed information about the diverse needs of service users and the specific support needed from staff can result in inconsistent practice and runs the risk of failing to meet all of the service users needs. The plan is reviewed monthly. Staff complete a daily record for each service user and inform management of any changes to service users needs. There was evidence that risk assessments are not always done. One service user had had a “bad fall in Feb 2005” Nothing had been recorded on the risk assessment. Further training is planned for staff to improve their care planning skills. Service users looked clean and well cared for and staff were observed providing support in a kind and helpful manner. They were able to give examples of best practice relating to the promotion of respect for the privacy and dignity of service users. Service users spoken to said that they received a very good service and are treated with respect. Comments like “Its very good living here” and “I love it” were heard. Staff promote the rights of service users to access the health care professionals that they need. Service users are registered with a GP and community nurses visit. One GP holds a weekly surgery in the home. Service users spoken to say they can see the doctor when they need to. A Health admissions form and management plan is completed for each person who uses the service. Pads were seen on some chairs. Conflicting explanations were given as to what their purpose is. One reason given was to protect the chair “If someone has an accident” This practice immediately identifies people who are incontinent and is therefore considered poor practice in the management of continence. It demonstrates a lack of respect for the privacy and dignity of service users and disregards the need to provide a discreet service. Service users are offered the opportunity to look after their own medication. Medication is administered and stored safely. The requirement set at the last inspection to store controlled drugs more securely has been achieved. . Service users find the lifestyle experienced in the home matches their expectations and preferences, and satisfies their social, cultural, religious and recreational interests and needs. Service users maintain contact with family/ friends/ representatives and the local community as they wish. Service users are helped to exercise choice and control over their lives. Service users receive a wholesome appealing balanced diet in pleasing surroundings at times convenient to them. The Commission considers all of the above key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 12,13,14 and 15 Quality in this outcome area is good. This judgement has been made using available evidence including a visit to the service. Service users benefit from flexible routines and opportunities for meaningful activities. EVIDENCE: Service users said that the daily routines are very flexible and that they are able to make choices in major areas of their lives. Staff were observed supporting people to do this. The lack of good care planning to establish service users cultural, social, religious and recreational interests and needs means that the service is probably only meeting some of the expectations and preferences of the people who use the service. Staff training and the homes policies and procedures focus on service users being in control of their lives. The home employs an activities organiser and a range of activities are available. Forthcoming attractions are displayed on the notice board. Benkhill Lodge - North Yorkshire County Council DS0000034358.V306972.R01.S.doc Version 5.2 Page 14 Throughout the day service users were occupying themselves watching TV, conversing with each other and staff, reading the daily newspaper, attending a religious service, listening to music, sitting outside and moving freely around the house. Service users spoken to said that appropriate activities are arranged. Bar facilities are available Monthly religious services mainly Church of England take place in the home and arrangements can be made for service users to attend church. Discussions are being held to try arrange for other denominations to provide a means of worship. Visitors are encouraged and made welcome. There is a private visitors room and if they have travelled a distance they are offered a meal. Menus are varied and nutritionally balanced. There is a choice of food at each mealtime and special diets are catered for. Service users mostly eat in the dining rooms but can have their meal in their bedroom if they prefer to eat alone. Dining room tables were set properly with tablecloths, mats, appropriate cutlery and condiments. A cold drink was provided followed by a hot drink after the meal. This was served from a trolley by staff. The meals are plated by the catering staff and served to service users with discreet support being provided when needed. Discussed with the manager the possibility of service users serving themselves from tureens on the table and having their own teapot, milk jug etc. Encouraging service users who can to help themselves promotes independence. Mealtimes were relaxed and unhurried allowing people as much time as they needed to complete their meal. A meal was taken with service users. It was nicely presented served hot and very tasty. Service users said they enjoy their food. Service users and their relatives and friends are confident that their complaints will be listened to, taken seriously and acted upon. Service users’ legal rights are protected. Service users are protected from abuse. The Commission considers Standards 16 and 18 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 16 and 18 Quality in this outcome area is good. This judgement has been made using available evidence including a visit to the service. Complaints are taken seriously and acted upon. Service users are protected from abuse. EVIDENCE: The home has a clear complaints procedure that highlights the importance of complaining if people are not happy with the service. The procedure is given to every service user. Records examined showed that complaints are dealt with speedily. Service users spoken to know how to complain and who to talk to if they are dissatisfied with any aspect of the service. This is a topic discussed in residents meetings, which makes sure that service users are familiar with the process and dispels any fears that service users may have about complaining. The policies and procedures regarding the protection of service users are robust and in line with best practice. Staff are provided with training and are aware of the need to report any allegations or suspicions of abuse to their manager. The home is clean, pleasant and hygienic. The Commission considers Standards 19 and 26 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 19 and 26 Quality in this outcome area is good. This judgement has been made using available evidence including a visit to the home. Service users live in a clean, safe and comfortable home. EVIDENCE: The home is furnished and decorated to a good standard. There are a number of communal lounges and other smaller sitting areas around the home. This provides service users with a choice of place to sit quietly, meet with family and friends or be actively engaged with other service users. The majority of bedrooms are smaller than the recommended size and do not have ensuite facilities. Service users bedrooms contain some of their own personal possessions, which promotes feelings of ownership. There are four bathrooms with assisted bathing facilities and toilets are placed strategically around the home. Call bells are within reach of service users and are responded to promptly. Aids and adaptations are provided and regularly serviced. The home is clean and fresh. The home employs a handyman who is responsible for routine maintenance and the monitoring of some health and safety aspects of the premises. The garden areas are well maintained and the courtyards are made attractive with planting and other garden features. Service users are supported and protected by the home’s recruitment policy and practices. Staff are trained and competent to do their jobs. The Commission consider all the above are key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 27,28,29 and 30 Quality in this outcome area is good. This judgement has been made using available evidence including a visit to the service. There are sufficient numbers of staff who are properly vetted and trained to ensure a good standard of service delivery. EVIDENCE: Staff were observed responding quickly and appropriately to requests from service users and spent time talking to them. Service users spoken to say that staff are always available to provide appropriate support and that they felt safe living in the home. One service user said “It is an excellent place “ The rota shows that there are enough staff employed on each shift and especially at times of peak activity. Agency staff are rarely used. The home has its own relief staff that they can call on in times of staff sickness and holidays. Staff files examined showed a satisfactory recruitment process, which endeavours to make sure that only suitable people are employed. All staff are subject to a probationary period. There is an induction programme that ensures new staff members are given the right information to be able to do their jobs well Staff spoken to said that the on going training programme is good, providing them with the skills and knowledge to meet service users needs. The training programme includes all the mandatory training needed to meet service users basic needs such as lifting and handling, food hygiene, and Benkhill Lodge - North Yorkshire County Council DS0000034358.V306972.R01.S.doc Version 5.2 Page 19 health and safety. Staff say that they are able to identify their training needs in supervision sessions with their manager. Over 50 of staff have achieved National Vocational Qualifications level 2 or above. Training is targeted and focussed on improving the safety and quality of life for people living in the home. This ensures that service users receive a service from an informed staff team whose practice is up to date. Service users benefit from the ethos, leadership and management approach of the home. The home is run in the best interests of service users. Service users are safeguarded by the accounting and financial procedures of the home. Service users’ financial interests are safeguarded. Staff are appropriately supervised. Service users’ rights and best interests are safeguarded by the home’s record keeping, policies and procedures. The health, safety and welfare of service users and staff are promoted and protected. The Commission considers Standards 31, 33, 35 and 38 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 31,33,35 and 38 Quality in this outcome area is good. This judgement has been made using available evidence including a visit to the service. The home is managed in a manner that promotes the right of service users to enjoy a good quality of life. EVIDENCE: The registered manager of the home recently resigned and a new appointment has been made. The new manager has previously been employed as a team manager in another North Yorkshire County Council care home for older people. She has also previously provided management cover at Benkill Lodge in times of staff absences. They also say that the management team are approachable and easy to talk to. Regular service user meetings, staff meetings and staff supervision promotes an open and transparent management style that is service user focused. The home has sound policies and procedures in line with current thinking and practice. Efficient systems are in place to monitor staff adherence to policies and procedures in their practice. The Quality Assurance scheme involves a quarterly Policy Performance Review and managers were able to give only one example of how this might improve service delivery. The quality monitoring system lacks the proactive involvement of people who use the service. There was no evidence of an annual development plan for the home reflecting the aims and outcomes for service users. A senior manager of the organisation does monthly audits of the service. These visits include discussions with some service users to ascertain their views on the service they receive. Service users are encouraged to manage their own financial affairs and spend their money as they wish. Staff provide support for service users who require help in managing their finances and there is a robust procedure in place to protect service users from financial abuse and directs staff in their practice. The home works to a clear health and safety policy and regular safety checks are carried out. Following a visit from a fire safety officer in May 2005 a recommendation was made regarding work needed to improve the means of escape in the event of fire. This work has not been done despite managers referring it to the appropriate buildings department. This lack of action has the potential to put service users at risk.
