This inspection was carried out on 29th December 2005.

CSCI has not published a star rating for this report, though using similar criteria we estimate that the report is Adequate. The way we rate inspection reports is consistent for all houses, though please be aware that this may be different from an official CSCI judgement.

The inspector found there to be outstanding requirements from the previous inspection report but made no statutory requirements on the home.

What the care home does well

There was good evidence available that the views of residents and relatives are sought about the quality of the service provided and in general levels of satisfaction were high. The feedback from residents and relatives in respect of how staff treated them was overall very positive with comments about how patient the staff were with residents and the good standard of care provided. Relatives spoken to were confident in the ability of the staff to care for residents. The food provided by the home also came in for some praise. Some of the record keeping was found to be well kept. The home currently has over the expected ratio of NVQ 2 (or above) trained care staff.

What has improved since the last inspection?

Significant progress has been made towards meeting previous requirements, the number of these outstanding reduced, with only eleven repeated out of the thirty three contained in the previous report. Some aspects of medication practice have improved along with aspects of kitchen hygiene management. Some measures have been taken to improve safety within the premises. Recording in a number of areas has improved, or is improving with such as activities now clearly documented on a daily basis over the last month. Checklists are now completed in respect of cleaning tasks, this seen in respect of the kitchen and overall premises. The homes training plan was also seen to carry better detail of when identified training needs were to be met.

What the care home could do better:

There is still much work to be done with a number of outstanding requirements that relate to major works required to improve the premises, contracts of residency, signing of care plans by residents, progressing access to a dentist, medication policy, provision of activities, ensuring risk assessments in respect of recruitment (without a disclosure) discussed with CSCI, commencing staff supervision and completion of the homes business/annual development plan. Additional issues identified included clarification on `as directed` medication,ensuring fire doors are only open with suitable devices and ensuring all the required safety checks (in respect of the hoists and hardwiring) are carried out.

This will remain until such time that the current service users placement is terminated. Date of last inspection Brief Description of the Service: Oaklands is a care home that can provide both nursing and personal care to older people on one site. The building is normally divided up into two distinct sections, The Lodge and the Manor, although the former is divided off at present pending building works. The home also offers accommodation to service users with a physical disablement and terminal illness. The staff group work under the supervision of one manager and consists of a number of nurses, care staff and some ancillary staff. Accommodation consists of 38 single and 8 double rooms, this subject to some change pending completion of an extension to the Lodge which means the home is only able to offer a proportion of its beds for accommodation at this time. There is one large communal space between the Manor and the Lodge. The home has a range of facilities and aids necessary for care of older people this including adapted bathing facilities, shaft lift, hoists, grab rails and similar. The home is sited close to the centre of Kingswinford and its facilities, but is positioned in the centre of a residential area. There is access to bus routes following a short walk. As mentioned, there are plans to extend the home on the Lodge side so as to enable the home to offer sufficient beds so as to fulfil its registered number. The CSCI have not been given any firm dates for the commencement of this work, although the Lodge side of the home is now sealed off with exploratory works underway. This inspection was carried out over one day between 10.20am and 2.15pm. Methods used to gain evidence including limited case tracking of some residents’ care, discussion with four residents, two relatives, management and staff, sampling of numerous records, and a partial tour of the premises. Prospective service users have the information they need to make an informed choice about where to live. Each service user has a written contract/ statement of terms and conditions with the home. No service user moves into the home without having had his/her needs assessed and been assured that these will be met. Service users and their representatives know that the home they enter will meet their needs. Prospective service users and their relatives and friends have an opportunity to visit and assess the quality, facilities and suitability of the home. Service users assessed and referred solely for intermediate care are helped to maximise their independence and return home. The Commission considers Standards 3 and 6 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 2,3,5 Residents have written contracts that do contain areas where there are omissions in the information required. Resident’s needs are assessed prior to their admission to the home, with confirmation given by the manager that the home can meet their needs. Prospective residents and their relative/friends have opportunity to visit and assess the suitability of the home for their needs. EVIDENCE: There was evidence within case files of contracts being supplied to residents or their representatives although there were noted to be omissions within this document including: - Who pays the fees (i.e. resident, representative, social services or health authority). - Clearer information as to the rights and obligations of the service user and who is liable if there is a breach of the contract by the registered Oaklands Nursing Home - KWD DS0000004881.V274621.R01.S.doc Version 5.1 Page 9 provider/service user (the home has a separate document detailing residents rights which could be amended and included within the contract); -For those residents in receipt of free nursing care a statement as to how this impacts on the fees charged and the proportion of the service that is free, dependent on the level of financial assistance. Examination of the case file for the last resident admitted to the home showed that there were copies of assessments carried out by funding bodies prior to admission, these supplemented by the homes own assessment. There was also evidence of the home confirming in writing to the resident’s representatives, that based on pre admission assessments, the home was able to fully meet the residents needs. Discussion with the relatives and the resident evidenced that they were able to look around the home prior to admission after arriving unannounced. They were made to feel welcome and the manager was very helpful in providing information about the home and answering any queries. The service user’s health, personal and social care needs are set out in an individual plan of care. Service users’ health care needs are fully met. Service users, where appropriate, are responsible for their own medication, and are protected by the home’s policies and procedures for dealing with medicines. Service users feel they are treated with respect and their right to privacy is upheld. Service users are assured that at the time of their death, staff will treat them and their family with care, sensitivity and respect. The Commission considers Standards 7, 8, 9 and 10 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 8,9 Most of the resident’s health care needs are fully met. Whilst there has been improvement in, there are still practices in respect of medication handling, policy and recording that need improvement. EVIDENCE: There were clear records of residents contact with health services (including G.P, district nurses, consultants etc) this showing that access to these was maintained with the exception of dentists and opticians, this an area where the home is now taking action to ensure that all residents have consultation. Half the residents have seen an optician and the manager stated she was waiting for the dentist to contact the home with dates to visit. There was good recording in respect of tissue viability and nutritional risk assessment these clearly identifying areas of high risk. There has been some revision of the medication policy, this now containing information as to the action to be taken in case of medication error and use of homely remedies. There is still a need to detail more information in respect of self-administration and what action to take when residents may take medication away from the home. There was notable improvement in the Oaklands Nursing Home - KWD DS0000004881.V274621.R01.S.doc Version 5.1 Page 11 records with no evidence of any gaps in respect of medication signed out over the month prior to this inspection. There was also clear evidence for any changes in medication, this through the home keeping copies of prescriptions; although there is a need for the home to clarify and retain evidence of the regime for medications that are denoted to be taken ‘as directed’, this usually applicable to eye drops. The supplying pharmacist has recently carried out an audit on the homes systems for the management of medication and stated that were satisfactory. Service users find the lifestyle experienced in the home matches their expectations and preferences, and satisfies their social, cultural, religious and recreational interests and needs. Service users maintain contact with family/ friends/ representatives and the local community as they wish. Service users are helped to exercise choice and control over their lives. Service users receive a wholesome appealing balanced diet in pleasing surroundings at times convenient to them. The Commission considers all of the above key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 13,14 Residents are able to maintain contact with their family, friends and representatives as they wish. Residents have opportunities to exercise some choice and control over their lives. EVIDENCE: The inspector was able to discuss visiting arrangements with some relatives during the course of the inspection. This evidenced that there was no restriction on visiting times and that hospitality was always offered by staff, who were also stated to make them feel welcome at the home. Details of visiting arrangements were seen to be on display in the foyer of the home, although the manager was advised that relatives should be given written information as to how the home would support and encourage their contact with residents on an on-going basis, this at the point the resident is admitted to the home. Also of note was that the visitors spoken to stated that the manager and staff did keep them well informed of their relative’s progress. Residents are able to handle their own financial affairs if wished, although their representatives mostly handle these. Information as to other agencies that can represent the residents is available at the home. Residents are able to bring items of furniture into the home within space and safety restrictions. Oaklands Nursing Home - KWD DS0000004881.V274621.R01.S.doc Version 5.1 Page 13 Discussion with residents did indicate that they had choice in respect of areas such as meals, privacy (i.e. going to bedroom when wishing to) and as to whether they wish to have locks on their bedroom doors. Whilst activities were not assessed in depth it was noted that there was seemingly some improvement in the activities are offer to residents, although improvement in this area needs to be continued. It was also suggested to the manager that as there is a wipe clean board in the dining room, that the meals of the day are written on this in larger print than that in the four-week menus that were seen to be available. Service users and their relatives and friends are confident that their complaints will be listened to, taken seriously and acted upon. Service users’ legal rights are protected. Service users are protected from abuse. The Commission considers Standards 16 and 18 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): These outcomes were not fully assessed at the time of this inspection EVIDENCE: Whilst these outcomes were not fully assessed at the time of this inspection it was noted that there was very clear directions in the office for the benefit of staff indicating what steps they must take if there was an allegation of abuse. There were also numerous notices indicating that staff must not use draglifting techniques, none of which were witnessed at the time of this inspection. Service users live in a safe, well-maintained environment. Service users have access to safe and comfortable indoor and outdoor communal facilities. Service users have sufficient and suitable lavatories and washing facilities. Service users have the specialist equipment they require to maximise their independence. Service users’ own rooms suit their needs. Service users live in safe, comfortable bedrooms with their own possessions around them. Service users live in safe, comfortable surroundings. The home is clean, pleasant and hygienic. The Commission considers Standards 19 and 26 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 19 Residents are living in an environment that needs to be better maintained. EVIDENCE: The premises are poor and are in urgent need of improvement. Whilst the grounds are tidy and safe the internal premises are in urgent need of redecoration as wallpaper is dirty and ripped throughout the home. Wheelchairs have damaged doorframes; carpets are dirty and frayed. Bath and shower rooms are stark, not homely and in need of refurbishment. A number of previous requirements relating to the improvement of the premises have not been met. It is planned to undertake building works imminently and this includes the Inspectors were told refurbishment of existing premises but a written plan with timescales (in respect of this area) were still not available, although it was noted that some plans for this work are available to residents and visitors in the foyer. Oaklands Nursing Home - KWD DS0000004881.V274621.R01.S.doc Version 5.1 Page 16 Some areas of concern identified in respect of the cleanliness of the premises identified at the time of the last inspection have now been addressed, this including the introduction of a checklist for cleaning tasks that includes all privacy screens. Liquid soap and a hand wash sign were now also seen to be displayed in the laundry. In addition there were no odours apparent in any part of the home inspected. Issues in respect of the cleanliness of the kitchen at the time of the last inspection have also been addressed. There were a few fire doors found to be opened, one with a door guard, the other two with furniture or other items, these seemingly so wedged by the occupant of the room. Where fire doors are to be kept open in accordance with the wishes of the resident then suitable hold open devices must be fitted in accordance with any advice from the Fire Prevention Officer at West Midlands Fire Service. The manager has produced a review form that is to be used for assessment in respect of residents needs for an adjustable bed. Service users’ needs are met by the numbers and skill mix of staff. Service users are in safe hands at all times. Service users are supported and protected by the home’s recruitment policy and practices. Staff are trained and competent to do their jobs. The Commission consider all the above are key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 27,28,29 There were sufficient allocated care staff and nursing staff to meet the needs of the residents accommodated at the time of the inspection. Residents are now better supported by the homes recruitment policy and practice than at the time of the last inspection. Residents are in the hands of a good proportion of staff that are suitably trained in the provision of ‘safe’ care. EVIDENCE: Based on the required number of care staff hours needed to satisfy the staffing calculation from the department of health recommended residential forum staffing tool there are sufficient allocated hours. There was however only thirty residents accommodated at the time of the inspection and care needs to be taken to ensure that when these numbers and the dependency levels increase staffing levels reflect this. The allocated nursing hours were not used as part of the total care staffing calculation. The manager is awaiting to employ an additional domestic, this subject to recruitment checks. The current staffing hours translates into one nurse over the 24hr period, five care staff during the morning/early afternoon, four care staff early afternoon/evening and 2 overnight. Ancillary staff include laundry assistants, domestics and cooks. Oaklands Nursing Home - KWD DS0000004881.V274621.R01.S.doc Version 5.1 Page 18 An audit of the one staff member recruited since the last inspection showed that the checks carried out were appropriate with the exception of the manager not discussing the risk assessment carried out by the home with the CSCI prior to employment. The home was seen to have a training plan that now identifies the projected dates by which staff will receive training in specific areas. Over 50 of the care staff have achieved NVQ level 2. Service users live in a home which is run and managed by a person who is fit to be in charge, of good character and able to discharge his or her responsibilities fully. Service users benefit from the ethos, leadership and management approach of the home. The home is run in the best interests of service users. Service users are safeguarded by the accounting and financial procedures of the home. Service users’ financial interests are safeguarded. Staff are appropriately supervised. Service users’ rights and best interests are safeguarded by the home’s record keeping, policies and procedures. The health, safety and welfare of service users and staff are promoted and protected. The Commission considers Standards 31, 33, 35 and 38 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 31,36,38 Residents live in a home, which is run by a manager who is fit to be in charge, of good character and sufficiently trained to be able to discharge her responsibilities. Staff are not appropriately supervised. EVIDENCE: The manager of the home has been registered by the CSCI since the last inspection of the home and was found to be ‘fit’ to be in charge, of good character and appropriately trained to manage the home appropriately. The manager is nurse trained and has also completed her Registered Manager’s Award. Discussion with the manager indicated that she has yet to commence formal supervision of staff, this stated to be due to the fact that she was getting to Oaklands Nursing Home - KWD DS0000004881.V274621.R01.S.doc Version 5.1 Page 20 know them after becoming manager in the latter half of 2005. The supervision of staff needs to be commenced as a matter of priority. There were some issues identified in respect of safety checks this including the following: - There is a need for more coloured coded knives in the kitchen. - The home is due its five yearly hardwiring check. - There was no evidence that hoists were service six monthly. It was agreed at the time of the inspection that evidence would be forwarded to the CSCI by the 6/1/06, this not received. - There was no evidence of the parker baths having been serviced. It was however pleasing to see that there is no a better cleaning schedule in place in the kitchen, this identifying cleaning tasks and frequencies at which they are to be carried out. Some new colour coded chopping boards have also been purchased. The homes fire risk assessment was also seen to have been revised, with fire records now far better organised. STATUTORY REQUIREMENTS This section sets out the actions, which must be taken so that the registered person/s meets the Care Standards Act 2000, Care Homes Regulations 2001 and the National Minimum Standards. The Registered Provider(s) must comply with the given timescales. No. 1. Standard OP2 Regulation 5(1) b Requirement The registered provider must revise the contract/statement of terms and conditions so as to include: Fees payable and by whom (for example the service user, representative, social services or health authority). A clear statement as to the rights and obligations of the service user and who is liable if there is a breach of the contract by the registered provider/service user. A clear statement for those service users that receive free nursing care as to how this impacts on the fees charged and what proportion of the service is free, dependent on the level of financial assistance. This is a repeated requirement that has been partially met but should have been fully met by the 31/10/05 4. OP9 13(2) To clarify and retain evidence of the regime for medications that are denoted to be taken ‘as directed’. This matter should be referenced within the homes medication policy. The Home ensures that the medication policies and procedures are reviewed and expanded to include: - Clarity about self administration for residents; - Residents taking medicines away from the home. This is a repeated requirement that was to have been met by the 31/10/05. The registered provider must make suitable arrangements to allow residents to engage in activities, as is their choice. This is a repeated requirement That has been partly met. Work to fully met this requirement must be continued. To submit an action plan with timescales for redecoration, renewal of damaged doorframes, recarpeting, refurbishment of shower and bathrooms, kitchen equipment cleaning schedule and any other matters detailed in the body of this report. This is a repeated requirement that was to have been met by the 30/11/05 Where fire doors are to be kept open in accordance with the wishes of the resident then suitable hold open devices must be fitted in accordance with any advice from the Fire Prevention Officer at West Midlands Fire Service.
