Date of last inspection Brief description of the care home Lakeland View is registered with the Commission to provide nursing and residential care for older people and for people with dementia. The maximum number of people who can be accommodated is 33. The home is located in the Heysham Road area of Morecambe, close to bus routes and Care Homes for Older People Page 2 of 8 Brief description of the care home shops. Lakeland View has three floors and there is a passenger lift in place. There is parking space and a small garden area to the front of the building, with a patio to the rear of the dining room. The home provides a range of communal living rooms including two main lounges, a small conservatory, a separate lounge for those people who smoke and a large airy dining room. There is a Statement of Purpose, Service Users Guide and Information Pack that is given to all prospective residents; this is a set of written information that tells you about the care service that is offered and what the resident can expect if he or she decides to live at the home. The home is owned by Mr Frank Nicholls and the registered manager is Mrs Bernadette Wallbank. Details of the current fees can be obtained by contacting the home. Care Homes for Older People Page 3 of 8 What we found: This visit was carried out in response to a concern which had been raised regarding the number of people accommodated at the home and the service user category of those accommodated. The information received stated that the home had 34 people resident and is only registered to accommodate 33 and that people with mental health problems as their main area of need were being admitted to the home, which is only registered to accommodate older people and people with dementia. On the 20th May the registered provider had been informed of the concern regarding accommodating more than 33 people and had confirmed that there were currently 33 people staying at the home and had provided the names of these residents. The registered provider and the registered manager of the home were spoken with during the visit and assessment documentation was viewed.The registered provider confirmed that there had been one recent occasion when 34 people had been accommodated at Lakeland View. An individual who had been staying at the home was discharged to hospital and was then due to be accommodated elsewhere. On the day of discharge the hospital had contacted the home as they were not aware that the individual was going to a different setting. The Social Worker was not available and the necessary arrangements had not been put in place. As this was late in the afternoon the registered provider agreed that the individual could return to Lakeland View for one night and be accommodated in a spare bedroom and this took the number of people accommodated at the home above 33. The following day staff from Lakeland View helped to make the necessary arrangements for this person to move to the assigned accommodation, which included buying food and essential items.The registered provider explained that he had felt a moral obligation to receive this person back into the home for one night. The registered provider was informed that exceeding registration numbers was an offence under the Care Standards Act 2000 (Section 24. Failure to comply with conditions) and that any non compliance in the future could result in legal action being taken against him. The registered provider was also reminded that there had been opportunity to disclose information regarding this situation, during the recent telephone conversation informing him of the concern. The assessment information for eight people who had been admitted to the home during 2009 was examined. Although it was evident that some of these people had additional mental health needs and in some cases a diagnosis of mental disorder, the records viewed showed that these people all had a diagnosis of dementia or identified nursing needs relating to old age. There was no evidence to show that people who had a primary care need resulting from a mental health diagnosis other than dementia were being accommodated at the home. The registered provider was reminded of the need to meet the needs of all those accommodated at Lakeland View, including those with a duel diagnosis and to be mindful of changing needs which may require a reassessment to ensure that Lakeland View is the best place for them to be.
