Conditions of registration: Date of last inspection 25 August 2005. Brief Description of the Service: 1 Larpool Lane is a care home providing personal care and accommodation for up to 51 older people. It is owned by North Yorkshire County Council. The premises located on the eastside of of Whitby about 1 mile from the ‘old town’ shops and amenities provides resident accommodation over 2 floors and has a passenger lift. All bedrooms are for single single occupancy. There is level access to the front and rear of the grounds where suitable garden furniture is provided. This is an overview of what the inspector found during the inspection. The unannounced inspection took place over a 3-hour period. The registered manager was not available and the inspection was facilitated by a deputy manager other staff members. The home was running well; residents said that they had enjoyed a ‘New Years’ party the day previously to which friends and family members had been invited. Overall the home presented as being clean although it was discussed with the person in charge that an unpleasant odour of urine was detectible in the entrance hall and some ground floor areas. The home’s registration certificate advises that the home is registered to accommodate 52 people. The home has however 51 single bedrooms. The person in charge during this visit advised that a bedroom has recently been made into a bathroom. It is not clear if this information has been formally passed to the registering authority. What the service does well: What has improved since the last inspection?
A new bathroom has been created on the lower ground floor. A bathroom on the ground floor has a new style accessible bath fitted and the bathroom has been re-painted. Each service user has a written contract/ statement of terms and conditions with the home. No service user moves into the home without having had his/her needs assessed and been assured that these will be met. Service users and their representatives know that the home they enter will meet their needs. Prospective service users and their relatives and friends have an opportunity to visit and assess the quality, facilities and suitability of the home. Service users assessed and referred solely for intermediate care are helped to maximise their independence and return home. The Commission considers Standards 3 and 6 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 1,4 and 6 Appropriate information is provided to all prospective residents and/or their representative. Written confirmation is not provided to people advising them that the home can meet their needs. Intermediate care is not provided. EVIDENCE: The home’s statement of purpose and service user information was examined evidencing that prospective residents and their representatives are provided with a range of useful information prior to being admitted. However the person in charge said that prospective residents and /or their representative do not receive written confirmation confirming that the home can meet their assessed needs. The home does not offer intermediate care services.

The intended outcomes for Standards 7 – 11 are: 7. 8. 9. 10. 11. The service user’s health, personal and social care needs are set out in an individual plan of care. Service users’ health care needs are fully met. Service users, where appropriate, are responsible for their own medication, and are protected by the home’s policies and procedures for dealing with medicines. Service users feel they are treated with respect and their right to privacy is upheld. Service users are assured that at the time of their death, staff will treat them and their family with care, sensitivity and respect. The Commission considers Standards 7, 8, 9 and 10 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 10 Resident’s rights to dignity and privacy are not always upheld. EVIDENCE: From direct observation it is clear that staff treat residents with respect, people spoken with said that staff treat them well. However the home’s ‘communal’ lavatory facilities are of a cubical style. Clearly residents have become used to this style of facility since their admission and have in effect not been given a choice in respect to this issue. Although generally such cubical facilities are commonplace in public toilets, where more space is required for wheelchair users and/or where personal assistance is required, public disabled facilities are generally of a style that provide space and comfort for residents and helpers and ensure that privacy and dignity is upheld. The type of lavatory facilities provided communally in this home fall short of this standard.

The person in charge during this visit said that it is North Yorkshire County Council’s [LA’s] intentions to replace this style of lavatory with more conventional facilities. From previous inspection reports it is clear that this issue has been raised with the LA over a protracted period of time. This situation is unsatisfactory. The Commission considers Standards 16 and 18 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 18 The home maintains appropriate policies and procedures in respect to Adult Protection. EVIDENCE: The person in charge was spoken with in respect the home’s practice regarding adult protection. The staff member was clear about her responsibilities regarding this issue and understood what she would be expected to do should there be a suspicion that any abuse had or was likely to take place in the home. The organisation ensures that appropriate policies and procedures are in place to provide guidance for staff about this issue. However the person in charge said that staff had not undertaken training specific to the recognition and/or handling an abusive situation. The staff-training matrix which is kept on the home’s computer showed that although a range of care related training has been undertaken by management and staff with regular updates, adult protection training has not yet been completed. Service users live in safe, comfortable bedrooms with their own possessions around them. Service users live in safe, comfortable surroundings. The home is clean, pleasant and hygienic. The Commission considers Standards 19 and 26 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 21 and 26 The lavatories provided are not wholly suitable for people accommodated. Unpleasant odours were detected in some communal areas of the home. EVIDENCE: The home provided sufficient toilets for the numbers of people accommodated. However the style of lavatory provision does not wholly met the needs of people accommodated. There are privacy and dignity issues in respect to the provision of cubical style lavatories throughout the home. [Please refer to standard 10] There are also issues regarding the difficulty that staff find when attending to the continence needs of residents particularly should the resident be a wheelchair user or require staff to assist. From direct observation of the space provided by this style of lavatory it is clear that they are not suitable for all people accommodated.

It is required by this report that a timescale be forwarded to the Commission in respect to this issue being resolved. A tour of the home was undertaken that showed the home was generally clean and tidy although some smaller sitting rooms were being used to store spare furniture. However it was concerning to note that some communal areas of the home smelled strongly of urine, particularly the entrance hall and corridors on the ground floor. Service users are supported and protected by the home’s recruitment policy and practices. Staff are trained and competent to do their jobs. The Commission consider all the above are key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 29 Not all records required to be made available for the purpose of regulation were made available. EVIDENCE: The National Minimum Standards, ‘Care Homes for Older People’ recommend that residents are supported and protected by the home’s recruitment policy and practice. The only way in which this situation can be evidenced is that all recruitment records required by Schedule 2 and Schedule 4 (6)of the Care Homes Regulations 2001are made available for the purpose of regulation. On the day of this visit these records were incomplete. The recruitment records of the 3 most recent people employed as care workers were requested. In the case of 2 people no records were available and in the case of 1 person partial records were available. The organisation has agreed previously that a copy of all recruitment records will be made available in the home; on this occasion this was not the case. There was evidence however that the Criminal Records Bureau [CRB] and Protection of Vulnerable Adults [POVA] disclosures for all 3 people had been satisfactorily received.

Service users benefit from the ethos, leadership and management approach of the home. The home is run in the best interests of service users. Service users are safeguarded by the accounting and financial procedures of the home. Service users’ financial interests are safeguarded. Staff are appropriately supervised. Service users’ rights and best interests are safeguarded by the home’s record keeping, policies and procedures. The health, safety and welfare of service users and staff are promoted and protected. The Commission considers Standards 31, 33, 35 and 38 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for the following standard(s): 33 It is not evidenced that the home is run in the best interests of residents. EVIDENCE: Although the home undertakes quality assurance monitoring based on seeking the views of residents and/or their family and others about the service it provides. There is no evidence that the resulting information is used. There is no evidence made available for the purpose of regulation in the home that the feedback from people targeted by the questionnaires is used to provide an annual development plan to improve and develop the environment and or services provided by the home.
