What the care home does well The recent refurbishment of the home had been carried out to a high standard. This provided modern facilities and a pleasant living environment for people using this service in the future. What has improved since the last inspection? Shortfalls in the home`s environment that presented potential risks to the safety of people using the service had been addressed. Improvements to the remaining outstanding requirements could not be assessed, as the home was not providing a service at the time of our visit. What the care home could do better: Four requirements were outstanding from previous inspections. These related to shortfalls in meeting healthcare needs, recruitment procedures, staff training and health and safety. Two further requirements were made during this inspection visit. The manager had not submitted a self-assessment document that we asked for and the provider had failed to notify the Commission that the registered manager no longer worked at the home. This means the people who use this service experience adequate quality outcomes. This report is based on information gathered by the Commission for Social Care Inspection (CSCI) We conducted an unannounced visit to the home on Wednesday 26th November 2008 to assess core standards of the National Minimum Standards relating to older people living in care homes. Visits form part of the overall inspection process along with assessment of other information received by the Commission in respect of this service. We also asked the manager to complete and submit an Annual Quality Assurance Assessment (AQAA) which is a selfassessment of the quality of service being provided. The inspection process is used to decide how often the home needs to be visited to make sure that it meets the required standards. The home was not providing a service at the time of our visit, and the manager did not submit the AQAA as requested, so it was not possible to assess all the core standards on this occasion. Consequently, the majority of shortfalls identified in this report relate to requirements that were outstanding from the previous key inspection in November 2007 and random inspections that were undertaken during June and July 2008. During our visit we were informed that the registered manager no longer worked at the home. The person who had been appointed to manage the home was present throughout the visit. This judgement was based on evidence that people using the service did not always have an appropriate assessment of their needs prior to moving into the home. The service user’s health, personal and social care needs are set out in an individual plan of care. Service users’ health care needs are fully met. Service users, where appropriate, are responsible for their own medication, and are protected by the home’s policies and procedures for dealing with medicines. Service users feel they are treated with respect and their right to privacy is upheld. Service users are assured that at the time of their death, staff will treat them and their family with care, sensitivity and respect. The Commission considers Standards 7, 8, 9 and 10 the key standards to be inspected. JUDGEMENT – we looked at outcomes for the following standard(s): 7, 8, 9 and 10 Quality in this outcome area is adequate. Failure to consistently meet the personal and healthcare needs of people who used this service placed their health and welfare at risk of harm. This judgement has been made using available evidence including a visit to this service. EVIDENCE: In response to concerns raised by a whistle blower in June 2008, five visits were made to the home by three inspectors between 12th June and 14th July 2008. These visits constituted two random inspections dated 12/06/2008 and 14/07/2008. The concerns alleged that people living in the home were not having their personal and healthcare needs met and that this placed their health, safety and welfare at risk. Manchester Social Services also conducted an investigation of the concerns under their safeguarding adults from abuse procedures. The outcome of our inspection visits undertaken on 12th, 17th, 18th and 24th June and Social Services investigation found evidence to substantiate Westwood Nursing Home DS0000070378.V373273.R01.S.doc Version 5.2 Page 11 the whistle blower’s concerns. We made seven requirements under ‘Health and Personal Care’ in the random inspection report dated 12th June 2008. As a result of the Social Services investigation several people, whose needs were not being met and whose welfare was seriously at risk, were removed from the home. Two inspectors conducted a further random inspection visit on 14th July 2008 and social services and the Primary Care Trust continued to monitor the welfare of the people remaining in the home. During this visit we assessed that six of the seven requirements had been met. In July 2008 the provider of this service announced the company’s decision to discontinue providing a service to older people and a month’s notice was issued to the remaining people living in the home. Manchester Social Services provided assistance to people in finding alternative care and accommodation and the last person moved out of the home on 19th August 2008. The service has been dormant since that date. Standards in this outcome group could not be assessed when we visited the home on 25th November 2008, as the service was not operating. Consequently, the judgement made at the last key inspection on 15th November 2007 has been reiterated in this report. This judgement has based on evidence that the standards relating to medication and personal and healthcare needs had not been consistently met. Service users find the lifestyle experienced in the home matches their expectations and preferences, and satisfies their social, cultural, religious and recreational interests and needs. Service users maintain contact with family/ friends/ representatives and the local community as they wish. Service users are helped to exercise choice and control over their lives. Service users receive a wholesome appealing balanced diet in pleasing surroundings at times convenient to them. The Commission considers all of the above key standards to be inspected. JUDGEMENT – we looked at outcomes for the following standard(s): 12, 13, 14 and 15 Quality in this outcome area is adequate. The range of activities provided to people using this service is limited. People are enabled to maintain contact with family and friends. This judgement has been made using available evidence including a visit to this service. EVIDENCE: Standards in this outcome group could not be assessed because there were no people receiving a service at the time of our visit. Consequently, the judgement made at the last key inspection on 15th November 2007 has been reiterated in this report. This judgement was based on evidence that people using the service received little stimulation or interest from the activities that were being provided. JUDGEMENT – we looked at outcomes for the following standard(s): 16 and 18 Quality in this outcome area is adequate. Staff development and the systems and procedures used to manage complaints and safeguard people from abuse did not afford adequate protection to the welfare and safety of people using this service. This judgement has been made using available evidence including a visit to this service. EVIDENCE: At the random inspection visit in June 2008, serious shortfalls were identified in relation to complaints recording and investigation and staff training in how to keep people safe from harm. Some progress had been made in these areas by the time of our second random inspection of the service in June 2008. Standards in this outcome group could not be assessed during this visit because the service to older people was not operating. Consequently, the judgement made at the last key inspection on 15th November 2007 has been reiterated in this report. The person appointed as manager was in the process of reviewing policies and procedures relating to complaints and safeguarding of vulnerable adults from harm. She demonstrated a thorough knowledge of current good practice in managing complaints and the action she would need to take if people using the Westwood Nursing Home DS0000070378.V373273.R01.S.doc Version 5.2 Page 14 service were suspected of being at risk of harm. She told us that staff would receive training in these areas prior to commencement of the new service. The home is clean, pleasant and hygienic. The Commission considers Standards 19 and 26 the key standards to be inspected. JUDGEMENT – we looked at outcomes for the following standard(s): 19 and 26 Quality in this outcome area is good. The refurbishment of this home has provided a safe, comfortable and pleasant living environment for people who will be using this service. This judgement has been made using available evidence including a visit to this service. EVIDENCE: At the time of our visit a major refurbishment of the home was nearing completion. We toured the environment to assess the quality of décor, fixtures and fittings, cleanliness, hygiene and health and safety. The refurbishment had been carried out to a high standard with attention being paid to managing health and safety. The person appointed as manager had an action plan in place to maintain good standards of hygiene, cleanliness and maintenance. The Commission consider all the above are key standards to be inspected. JUDGEMENT – we looked at outcomes for the following standard(s): 27, 28, 29 and 30 Quality in this outcome area is adequate. Evidence needs to be provided that recruitment procedures and staff development afford protection to people using the service. This judgement has been made using available evidence including a visit to this service. EVIDENCE: The three previous inspections identified shortfalls in undertaking required preemployment checks prior to confirming staff in post and a lack of relevant staff training. Standards in this outcome group could not be assessed during this visit because the service was not operating and nursing and support staff had not been recruited. The person appointed as manager of this home told us that she had drawn up a staff development programme and she was aware of the need to obtain prerecruitment checks. Service users’ rights and best interests are safeguarded by the home’s record keeping, policies and procedures. The health, safety and welfare of service users and staff are promoted and protected. The Commission considers Standards 31, 33, 35 and 38 the key standards to be inspected. JUDGEMENT – we looked at outcomes for the following standard(s): 31, 33, 35 and 38 Quality in this outcome area is adequate. Improvements were needed in management procedures to fully protect people using the service and ensure the home was managed in their best interests. This judgement has been made using available evidence including a visit to this service. EVIDENCE: The requirement made at our last inspection in July 2008 to ensure that windows in the home above ground-floor level be restricted to an opening width of 100cms had not been addressed. However, it was acknowledged that refurbishment work to the first floor had not been completed at the time of our visit. The provider had failed to notify the Commission of this in writing as required by Regulation 38 of The Care Homes Regulations. The provider must also notify the Commission in writing of the name, address and qualifications of the person who will be responsible for managing the care home and the date they were appointed. In August 2008 we wrote to the registered manager requesting completion of their Annual Quality Assurance Assessment (AQAA), which is a self-assessment of the quality of the service being provided. Care services are required to complete and submit an AQAA to the Commission every twelve months. Despite our reminding the service about this, they failed to submit the required information. Standards 33 and 35 in this outcome group could not be assessed because there were no people receiving a service at the time of our visit. Consequently, the judgement made at the last key inspection on 15th November 2007 has been reiterated in this report. The judgement was based on evidence of unmet standards in the areas of health and safety and safeguarding the financial interests of people using the service.
