This inspection was carried out on 19th May 2005.

The inspector found there to be outstanding requirements from the previous inspection report but made no statutory requirements on the home.

What the care home does well

Service users spoken with said that they liked the staff and because they all lived in the local area often knew them. They said that the food is excellent and one service user said it was `like farmhouse food`. A visitor said that she is always made welcome and the staff keep her informed of what is happening in the home and if there are any problems with her relative.

What has improved since the last inspection?

The home has become much better at making sure they can provide the support and assistance required by the service users admitted to the home. They have also introduced more social activities in to the home and staff are now able to spend more time with the service users.

What the care home could do better:

The home must make sure that when they are giving out the medicines that they do it properly. The tablets must not be left lying around waiting for the person to come to the dining room before giving them out. They must also make sure that advice given by the Fire Officer and the environmental health officer is implemented to make sure the home is a safe and hygienic place to live.

Date of last inspection 9th February 2005 Brief Description of the Service: Cherry Garth is a purpose built property standing in its own well-maintained grounds. It is situated a few minutes walk from the centre of Thirsk. The building occupies two floors and provides for a maximum of 48 service users. There are 40 single rooms and 4 shared bedrooms, none of which has an ensuite facility. There are communal bathrooms and toilets provided on each floor. There is a passenger lift. Communal rooms are located throughout the premises. This inspection, including preparation time took place over 13 hours. A tour of some areas of the building was conducted. A number of the service users records, staff records and records about the management of the home were inspected. 15 of the 41 service users, six of the nine staff on duty and two visitors were spoken with. Prospective service users have the information they need to make an informed choice about where to live. Each service user has a written contract/ statement of terms and conditions with the home. No service user moves into the home without having had his/her needs assessed and been assured that these will be met. Service users and their representatives know that the home they enter will meet their needs. Prospective service users and their relatives and friends have an opportunity to visit and assess the quality, facilities and suitability of the home. Service users assessed and referred solely for intermediate care are helped to maximise their independence and return home. The Commission considers Standards 3 and 6 the key standards to be inspected at least once during a 12 month period. The service user’s health, personal and social care needs are set out in an individual plan of care. Service users’ health care needs are fully met. Service users, where appropriate, are responsible for their own medication, and are protected by the home’s policies and procedures for dealing with medicines. Service users feel they are treated with respect and their right to privacy is upheld. Service users are assured that at the time of their death, staff will treat them and their family with care, sensitivity and respect. The Commission considers Standards 7, 8, 9 and 10 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for standard(s) 9 and 10 Service users are treated with respect and their privacy is respected. Service users are not protected, as medication is not handled in line with the home’s policy. EVIDENCE: Medication was seen to be put into small pots prior to being administered to a service user. There were at least 8 pots set up at the time of the inspection. The intended recipient was identified by a loose slip of paper with either their full name or their first name. This practice must cease. The medication records were up to date and. There is a medication policy which contains instruction to retain medicines for a minimum of 7 days following the death of a service user. Medication training has been provided for all staff who handles the medication. The interactions between the service users and staff observed during the inspection were seen to be relaxed, friendly and respectful. The service users spoken with confirmed that the staff were respectful at all times. Staff said that ensuring service users are treated with respect is a fundamental part of their Induction and foundation training. Service users find the lifestyle experienced in the home matches their expectations and preferences, and satisfies their social, cultural, religious and recreational interests and needs. Service users maintain contact with family/ friends/ representatives and the local community as they wish. Service users are helped to exercise choice and control over their lives. Service users receive a wholesome appealing balanced diet in pleasing surroundings at times convenient to them. The Commission considers all of the above key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for standard(s) 12, 13 and 15 Service users are encouraged to maintain contact with their families. They enjoy organised activities and a healthy and varied diet. EVIDENCE: Service users spoken with said they can dictate their own routines with limitations only around the routine of the home. They can get up or go to their rooms at any time and several service users remained in their own rooms for their meals or returned to their rooms between the meal times. Service users also confirmed that there are activities planned during the day and they can choose to attend or not. Service users spoken with said that they especially enjoyed the quizzes. Visitors were seen at all times of the day. Several spoken with said that they were always made welcome by the staff and kept informed of any issues or problems that affected their relative. The meals observed during the inspection were well presented and looked appetising. The meal times were unhurried and staff were observed to offer appropriate assistance to the service users. The menus are planned on a weekly basis and service users spoken with said that they enjoyed the food. Opportunity to influence the menus is provided through the resident meetings. Service users and their relatives and friends are confident that their complaints will be listened to, taken seriously and acted upon. Service users’ legal rights are protected. Service users are protected from abuse. The Commission considers Standards 16 and 18 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for standard(s) 18 Service users are protected from abuse. EVIDENCE: There is an Adult Protection Policy in place. Staff spoken with had received training in Adult protection issues and they had a good understanding of their responsibilities if they believed any inappropriate behaviour was taking place. Policies are also in place regarding the management of service users money. Staff are also subject to a criminal records bureau disclosure and a protection of vulnerable adults check to ensure that they are suitable to work in a care setting. Service users live in a safe, well-maintained environment. Service users have access to safe and comfortable indoor and outdoor communal facilities. Service users have sufficient and suitable lavatories and washing facilities. Service users have the specialist equipment they require to maximise their independence. Service users’ own rooms suit their needs. Service users live in safe, comfortable bedrooms with their own possessions around them. Service users live in safe, comfortable surroundings. The home is clean, pleasant and hygienic. The Commission considers Standards 19 and 26 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for standard(s) 19 and 21. Whilst service users are provided with a homely environment they cannot be assured that works required to ensure their safety are carried out. EVIDENCE: The location of the home is suitable for the needs of the service users. It is well maintained. There is an annual plan for the renewal and repair of equipment and furniture, and a handyman is employed to look after the gardens and to make small repairs in the home. There was no evidence that the requirements outlined in the fire officer’s report from October 2004 and the environmental health officer’s report of January 2005 have been actioned. There are sufficient bathroom facilities around the home. A previous requirement had been made about the need to remove the cubicle style toilets. This work is now planned and will happen in the near future although an exact start date was not available. Service users needs are met by the numbers and skill mix of staff. Service users are in safe hands at all times. Service users are supported and protected by the home’s recruitment policy and practices. Staff are trained and competent to do their jobs. The Commission considers Standards 27, 29, and 30 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for standard(s) 28, 29 and 30 The service users needs are met by staff who have received training and support to ensure they have the skills needed to meet their needs. EVIDENCE: The staff spoken with said that they receive supervision every two months and an appraisal meeting every year. They access training that is pertinent to their roles. There was evidence available that all staff are encouraged to do a National Vocational Qualification in care level 2. The staff files seen contained an application form, 2 references, and a criminal records disclosure, evidence of training and supervision notes. Service users live in a home which is run and managed by a person who is fit to be in charge, of good character and able to discharge his or her responsibilities fully. Service users benefit from the ethos, leadership and management approach of the home. The home is run in the best interests of service users. Service users are safeguarded by the accounting and financial procedures of the home. Service users’ financial interests are safeguarded. Staff are appropriately supervised. Service users’ rights and best interests are safeguarded by the home’s record keeping, policies and procedures. The health, safety and welfare of service users and staff are promoted and protected. The Commission considers Standards 33, 35 and 38 the key standards to be inspected at least once during a 12 month period. JUDGEMENT – we looked at outcomes for standard(s) 38 The health and safety needs of the service users is promoted. EVIDENCE: The staff spoken with confirmed that they had received training in health and safety, first aid, back care, food hygiene, COSHH, and fire training. Evidence of this was seen in the staff files. The equipment used in the building is serviced at the prescribed intervals. A discussion following the inspection with Joan Craft, regarding the validity of the electrical safety certificate determined it is still current. Accidents are properly recorded and where necessary reported to the Commission for Social Care Inspection. Information from the accident records is used in the care planning process. All staff have access to Induction and Foundation training, that gives them an understanding of their responsibilities as care workers. Standard 9 Regulation 13(2) Requirement Medication must be dispensed from its original packaging and only put in to a small pot at the time it is dispensed. (An immediate requirement notice was issued on the day of the inspection) All matters raised in the Fire Officers report of September 2004 must be addressed and resolved to ensure the continued safety of the service users, visitors and staff. (This is an outstanding requirement from the inspection on 09.02.2005.
