The inspector found no outstanding requirements from the previous inspection report, but made 6 statutory requirements (actions the home must comply with) as a result of this inspection.

What the care home does well

The staff are to be commended for continuing to ensure that the residents are cared for, despite their own concerns about the management and condition of the home.

What the care home could do better:

The premises are poorly maintained and a program of maintenance needs to be drawn up and followed to bring the home up to an adequate standard of repair. The needs of people with mobility problems are not well served as the passenger lift needs to be repaired and other mobility aids, including the hoists are in poor condition. The fire safety precautions need to be improved so that they meet all of the British Standards and could provide adequate protection for the residents in the event of a fire. The lack of clear management and leadership, unclear roles and responsibilities have had a negative impact on the service provided. The registered persons need to ensure that the residents, their representatives, the staff and the Commission need to know who is responsible for the day to day management of the service.

The home does not provide nursing care. The home is a large detached property situated on a quiet road about half a mile from the centre of the Devon seaside town of Teignmouth. Teignmouth benefits from having a train station and regular bus services. Care Homes for Older People Page 2 of 9 Information provided to the Commission tells us that the fee levels range from 372 and 425 pounds a week and that the actual fee charged depends on the assessment of individual residents needs and room occupied. Additional charges include chiropody 12 pounds, Hairdresser from 6.50 and paper/magazines at price charged. Care Homes for Older People Page 3 of 9 What we found: This random inspection was carried out in response to information received that the person who was in day to day charge of the home, but not registered as manager, was leaving her post the following day. We were told that she had made her decision to leave following the receipt of a letter from Mrs Brett suggesting measures that could be taken, including cutting management hours, as part of an economy drive. Concerns were also raised about the safety of the residents because of the condition of the premises, the mobility aids and the fire safety precautions. We were concerned that the staff on duty did not know what arrangements were being put in place for the day to day management of the home following the departure of the person who had, although not registered to do so, been managing the care home. We saw a fire safety risk assessment that had been carried on 9th January 2009. This told us that told us that the premises do not conform to the Regulatory Reform (Fire Safety) Order 2005 in respect of BS 476, BS 5839, BS 5266 and BS 5499. The report also states that the electrical appliance tests have not been carried out in accordance with The Electricity at Work Regulations 1989. We have contacted Devon and Cornwall Fire Service and asked them to carry out an inspection of the premises. We carried out an inspection of the premises during a site visit on 22nd January 2009 and saw that the parts of the home were poorly maintained. We saw three members of staff trying to help a resident who uses a wheelchair to access the communal toilet on the ground floor. The toilet was not large enough to accommodate her wheelchair and so she was being transferred from the hall to the toilet. It was clear that this experience was causing distress to the resident. A second communal toilet on the ground floor is not accessible to people with poor mobility or people with dementia as it is in a part of the home that is separated from the main accommodation by a combination lock and steps. During our visit we looked at the residents bedrooms and found all of them to be in need of some repairs, redecoration or refurbishment. We saw that an ongoing recommendation to fit radiator covers had not been dealt with and the risk of residents scalding themselves remains. The laundry facilities are in the basement and although the home has appropriate washing machines there is no drier. We saw that washing was being dried on clotheslines in a room in the basement and were concerned that the close proximity of a naked bulb to the washing lines could place the staff at risk of receiving a burns or an electric shock. The home has a passenger lift and reports of service visits carried out on 28th May Care Homes for Older People Page 4 of 9 2008 and 29th December 2009 show that some recommended repairs have not been carried out. At the time of the site visit we were told that the care staffing levels were three care staff on duty in the mornings and two in the afternoons, with an additional member of staff coming in to help at tea-time. In addition to this there is a cook and a cleaner. We were told that one care worker is on waking duty during the night and that it had been suggested that one of the two care workers who live on the premises could provide sleeping in cover. As it was observed that at least one resident needs two people to assist her to use the toilet, the minimum number of waking night staff on duty to meet her needs is two. The registered persons in control are Mr Stephan and Mrs Margaret Brett, they have not been in charge of the day to day running of the home for some time and although they have had appointed a manager this person has not applied for registration. A flat is retained at the home that the owners use when they carry out their statutory visits. Mr and Mrs Brett have formed a limited company to carry on the business but Brett Care Homes Limited had not applied to be registered at the time of this report. The Company Secretary is aware that the company need to apply for registration and has confirmed that this will be done. This includes ensuring that repairs to the lift are carried out. To enable the people with physical disabilities to access all parts of the home safely. 4 22 13 Suitable arrangements must be made to provide a safe system for moving and handling residents. 27/03/2009 Care Homes for Older People Page 7 of 9 To protect the residents and staff from harm. 5 22 23 As the home is registered to 27/03/2009 care for people with physical disabilities, suitable mobility aids must be provided and maintained in good order. To enable people with physical disabilities to use the bathrooms, toilets and passenger lift safely. Having regard to the size of the home and the number and needs of the residents, suitably qualified staff must be employed in sufficient numbers to meet the needs of the residents at all times of the day and night.
